Member Solutions Legal/Agency Liaison
Accountability Statement
The incumbent is responsible for performing recovery activities regarding charged-off accounts in accordance with Credit Union and legal guidelines, including related state and federal regulations. The Recovery Legal/Agency Liaison is primarily responsible for all activity related to several third-party agencies that handle collections-related matters, prepares files and documents required on accounts sent to debt sale companies and attorneys, and prepares all court documents for Small Claims Court litigation. Also handles telephone calls from members and other VyStar departments who call with questions concerning these agencies and other miscellaneous account issues. Inputs debt sales, legal or agency collection statistics, creates performance reports, and coordinates payment disbursements to agencies. Must understand Consumer Financial Protection Bureau (CFPB), Servicemembers Civil Relief Act (SCRA), Fair Credit Reporting Act (FCRA), Fair Debt Collections Practice Act (FDCPA), UDAAP and Federal Bankruptcy Laws and other regulations that could impact VyStar in the daily work handled by this position. Must be timely, meeting all deadlines and accurate in all activities.
Essential Job Functions
  • Work closely with management to develop, improve and implement post charge-off collection processes.
  • Serves as a subject matter expert in all phases of post charge-off collections.
  • Independently communicates and negotiates with debtors, legal offices, and debt sale agencies according to established protocol for resolution of case including explanation of collection procedures, ordinances and policies, and discussions regarding payment/settlement options.
  • Review submission requests for legal review via collection comments, case load analysis, defined approval standards and periodic desk reviews.
  • Approves advanced collection efforts beyond the Recovery Team's scope of authority (replevins, small claims suits, garnishments, levies, etc.).
  • Handle all referrals, replevins, litigation, and debt sales of post charge-off accounts within each assigned portfolio.
  • Prepare files and court documents for accounts taken to Small Claims Court with a strong understanding of loan calculations including default, APR, amortization schedules and simple interest.
  • Keep abreast of business and market trends that may affect recovery efforts such as but not limited to tracking of post judgment interest rates by location.
  • Monitors post charge-off bankruptcy accounts for potential repossession efforts up to and including relief from automatic stay actions in conjunction with the Asset and Loss Mitigation team.
  • Reviews DMV reports for proper placement and deletion of registration holds during and after repossession efforts on post charge-off loans.
  • Key liaison for attorneys and debt sale agencies; respond to requests and/or inquiries; including the gathering of data to represent the company at court and subpoena hearings
  • Monitors, communicates, and manages all attorney activity
  • Reviews post charge-off referrals for small claims litigation, and debt sales of post charge-off and bankruptcy accounts within each assigned portfolio.
  • Acts as liaison with third party collection agencies to include transfer of information, payments tracking and updating accounts related to post charge-off recovery, legal remedies, debt sales and other means of maximizing recoveries to the Credit Union.
  • Reviews, validates and approves affidavits or stipulation agreements for execution by VyStar Credit Union Representative.
  • Gathers documentation in preparation for VyStar Management to attend hearings and mediations.
  • Review and recommend accounts to be assigned to outside collection agencies when necessary.
  • Contacts business partners and vendors to ensure services provided are meeting predetermined service level agreements.
  • Process and validates proper posting of payments based on defined settlement authority guidelines to complete settlement and/or 1099 coding on charge-off accounts.
  • Works in conjunction with the Credit Reporting Team to ensure accounts settled for less than full balance reflect accurately on credit bureaus.
  • Assists with year-end tax reporting for IRS and to ensure that comprehensive reconciliation processes are in place to ensure compliance. This requires strong familiarity with 1099C & 1096 reporting, cancellation of debts as defined by the IRS and ensuring timely filing with IRS.
  • Works with department Analyst for enhancement to necessary reporting relative to legal, agency or debt sale files to include but not limited to payment, settlement and invoice tracking to mitigate expense control associated with post charge-off litigation actions.
  • Maintains current information regarding credit union policies, procedures, service products, or loans and deposits related regulations as well as system updates to perform duties properly.
  • Attends training sessions that are hosted by other departments, in addition to other training related to our service products, policy changes, or procedure changes.
  • Promotes the Credit Union by participating in community involvement and special events.
  • Performs other duties as assigned.
JOB KNOWLEDGE, SKILLS & ABILITIES
  • A minimum of three years’ experience in a collection, legal, mortgage, call center or customer service environment with a financial institution is required.
  • Three years of progressive collections experience including post charge off, high risk, deficiency balances, commercial and real estate collections, preferred.
  • Must have proficient verbal and written communication skills with the ability to utilize basic negotiation skills.
  • Proficient knowledge of Microsoft Office Suite products and related Bank software.
  • Demonstrated tact and professionalism when exchanging information with members, co-worker, vendors, and management.
  • Attention to detail while demonstrating accuracy in performing all work assignments.
  • Strong planning, time management and organizational skills.
  • Ability to manage confidential information.
  • Strong knowledge of laws and regulations associated with consumer rights and collections.
  • Paralegal or Legal office experience is preferred.
  • Spanish -speaking skills are highly preferred.
EDUCATION REQUIRED
An Associates degree is required or may substitute 4 years’ experience leading in a legal, collection, mortgage, call center or customer service environment within a financial institution.
Continuing education via local conferences, workshops, and webinars is required for updates and/or changes in the handling of the Consumer, Mortgage & Commercial loans governed federal and state regulations. Incumbent must maintain knowledge on all current requirements, industry changes and routinely share that knowledge with all staff members.
